Trump Appeals Illinois Judge’s Decision Over Primary Ballot Exclusion

United States – Donald Trump argued on Thursday at a federal court that the ruling by a Illinois District Judge to disqualify him from appearing on the state’s Republican presidential primary ballot as a result of his role in the insurrection at the U.S. Capitol on Jan. 6th, 2021 should be reversed, as reported by Reuters.

In her decision dated Wednesday, John-Cook County Circuit Judge Tracie Porter agreed with the voters of Illinois who argued that Trump shouldn’t run for the Democratic primary on March 19 and in the general election for the term starting November 5, 2019.

On Thursday the plan of Trump was to file a notice of appeal to Illinois’ 1st District Appellate Court on a day that came after when a spokesperson of Trump’s campaign claimed that this was an illegal decision.

Legal Basis for Exclusion

Porter ruled that Trump’s case violated the Anti-Insurrection clause of the 14th Amendment to the US Charter that disallows one to hold public office should he rebel against the constitution, take an oath to support the government, and further provide support to the insurrectionists.

Porter’s judgment had been stayed unofficially even before it was appealed by Trump.

It is expected that the Supreme Court of the USA will be the one to make the final decision regarding this Illinois case and similar challenges. On Feb. 8, a hearing involving Trump’s ballot qualification was granted by the highest court.

Regarding Trump’s appeal, the advocacy organization Free Speech For People, which led the Illinois disqualification effort, did not immediately respond.

National Implications and Ongoing State Challenges

Following their determination that Trump is ineligible under the Constitution, Colorado, and Maine have likewise eliminated him from their state ballots. Both rulings are pending while Trump files an appeal.

Trump ignored requests to encourage the mob to stop. His supporters stormed the capitol to prevent Democrat Biden from taking the Oath as the President, as reported by Reuters.

Trump’s Recourse and Ongoing Supreme Court Challenge

The current recourse for Trump is his challenge to the Colorado-based disqualification before the Supreme Court. It seemed the justices in Washington, DC leaned towards having the case not settled by the Supreme Court without taking into consideration states that can take far-reaching measures that can affect the whole national election.
